These General Terms of Use and Contracting (hereinafter, “the General Terms”) govern, together with the Privacy Policy and the Cookies Policy, access to and use of the website accessible through the domain name www.garciacarrion.es and its subdomains, as well as the contracting of products and/or services through it. Mere access to the Website grants the person doing so the status of User of the Website and implies acceptance of all the terms included in these General Terms. If you do not agree with these General Terms, you must immediately leave the Website without using it.

By accepting these General Terms, the User declares:

  • That they have read, understand, and comprehend the content herein.

In compliance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that this website is owned by J García Carrión, S.A. (hereinafter García Carrión), with registered address at Carretera de Murcia s/n 30520 Jumilla (Murcia) and with Tax ID A08267403, registered in the Commercial Registry of Murcia, in volume 1,445, folio 181, sheet MU-26.845, entry 2nd. García Carrión is the owner of the portal https://garciacarrion.com/ (hereinafter the Portal) and makes it available to Internet users (hereinafter the User or Users, as appropriate) in order to provide information about the company, its plants and wineries, its products and related promotions, as well as to enable the provision of various services through the Portal (User registration, newsletter subscription, and online purchase in its online store – hereinafter the Store, among others).

Access to our Website by the USER is free of charge and subject to prior full, express, and unconditional reading and acceptance of these GENERAL TERMS OF USE in effect at the time of access, which we ask you to read carefully. By using our portal, its contents, or services, the USER expressly accepts and agrees to the general terms of use herein. If the user does not agree with these terms of use, they must refrain from using this portal and operating through it.

1.2.- These General Terms of Use of the Portal, together with the general contracting terms governing the provision of services, and/or any specific terms that may be established, aim to regulate both the provision of information and the commercial relationships that arise between García Carrión and the Users of the Portal.

By browsing the Portal and/or using the services included therein (Registration, Newsletter, or Store), you acquire the status of User. Both browsing and the use of any of the services of the Portal imply acceptance by the User, without reservation of any kind, of all and each of these General Terms of Use, the General Contracting Terms that, where applicable, govern the provision of services offered on the Portal, as well as, where applicable, the Specific Terms that may exist regarding the provision of services.

1.3.- García Carrión may, at any time and without prior notice, modify these General Terms, as well as the General Contracting Terms set out in the following section (number 2), and/or the specific terms that may be included, by publishing such modifications on the Portal so that they may be known by the Users, always before visiting the Portal or acquiring any goods offered on the Portal.

2.- General conditions of contracting in the online store of https://garciacarrion.com/

2.1.- General contracting conditions.

2.1.1.- These general contracting conditions, together with any specific conditions that may be established, will expressly regulate the relationships arising between García Carrión and the “Users” who use the Store, as well as with third parties who contract the products offered through it.

2.1.2.- These General Terms have been drafted in accordance with the provisions of the following regulations:

  • Law 7/1998 on General Contracting Terms,
  • Law 7/1996 on Retail Trade Regulation,
  • Royal Decree-Law 14/1999 regulating Electronic Signatures,
  • Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
  • Organic Law 3/2018, of December 5, on Personal Data Protection and Guarantee of Digital Rights.

2.2.- Products offered. Purchase system.

2.2.1.- The products offered in the Store, along with their features and prices, will appear on screen.

Shipping costs to the User’s address for the products will also appear on screen, which will vary depending on the destination (inside or outside Spain) and the number of boxes sent. Shipping costs will be charged per full box in multiples of six bottles per box for 0.75 cl bottles, rounding these costs up to the nearest higher multiple of the number of bottles ordered by the User when it is not a multiple of six (6) bottles.

Products will be available for sale while stocks last. The prices indicated on screen are in euros and include VAT and any other applicable tax and are current.

Offers will be duly indicated on screen. García Carrión reserves the right to decide, at any time, the products contained and offered to Users through the Store. García Carrión may add new products to those included in the Store at any time, and unless otherwise stated, such new products will be governed by the provisions of the General Contracting Terms in effect at that time.

Likewise, García Carrión reserves the right to stop providing access, at any time and without prior notice, to any of the products offered in the Store.

2.2.2.- To purchase the products offered in the Store, García Carrión will require Users to register, for which they must be over eighteen (18) years of age, and must complete the instructions appearing on screen, including the following steps:

  • Complete the electronic form available on the Portal at all times, following the instructions indicated therein.
  • Click the “Accept” button.
  • Receive the “Username” and “Password” at the User’s email address.

The Username and Password are personal and non-transferable. García Carrión may, with proper notice, make changes to the username and/or password, in which case the modified credentials will lose their validity.

2.2.3.- Once registered, to proceed with the purchase of Products, the User must add the desired product to the Shopping Cart, following the instructions on screen, complete the order form provided, and send it to García Carrión, which implies reading and accepting all these General Contracting Terms, as well as any applicable Specific Terms.

The purchase will be deemed to have been made at García Carrión’s registered address, located at Carretera de Murcia s/n, 30520 Jumilla (Murcia).

2.2.4.- Once the purchase is made, and as soon as possible, always before thirty (30) days have elapsed from the execution of the purchase, García Carrión’s Customer Service Department will send the purchasing User, if requested, to the address indicated on the form or by email to the email account indicated during registration, the corresponding invoice. The order confirmation sent by García Carrión will not be valid as an invoice, only as proof of purchase.

2.3.- Payment method, delivery, and withdrawal of orders.

2.3.1.- Payment for purchased goods and associated shipping costs can be made by credit card, bank transfer, PayPal, or Bizum.

To pay by credit card, the User must follow the on-screen instructions and provide the following information:

  • Card number.
  • Expiry date.
  • CVV2 or CVC2 code of the card.

As an electronic payment system, García Carrión uses the Santander Elavon e-commerce payment gateway. All data provided for this purpose are encrypted under the SSL (Secure Socket Layers) protocol to guarantee maximum security.

García Carrión reserves the right to request from any Store User who has made a purchase proof of payment and/or identification by telematic means (fax, email, or similar) of a document identifying them as the buyer and which may include the delivery address (ID, Passport, Resident Card, Registration Certificate, etc.).

2.3.2.- García Carrión undertakes to deliver the goods purchased by the User to the buyer’s address indicated for this purpose in the order form (no deliveries to PO boxes or call centers), as quickly as possible and, in any case, always within two (2) working days to mainland Spain or four (4) working days (Monday to Friday) from the order date (excluding holidays and weekends). Shipping costs will be paid by the Buyer.

2.3.3.- The Buyer will have a period of fourteen (14) business days, according to the official calendar of their place of residence, to cancel the purchase without incurring any penalty or expense, except for the costs of delivery and return of the goods.

The fourteen-day period mentioned above will be counted from the date of receipt by the buyer of the purchased goods. However, if the buyer became aware of the right of withdrawal after receiving the purchased goods, the fourteen-day period will start from the date they became aware of their right to return, at their expense, the purchased goods. In any case, the buyer is deemed to have known about the right of withdrawal from entering the Store, which requires reading and accepting these General Contracting Terms, and in any case from the time the order is placed.

Once the buyer exercises the right of withdrawal and the perfect and unaltered condition of the goods is verified in García Carrión’s warehouse, the amounts received will be refunded without any retention, except for delivery and collection costs, immediately and never later than thirty days.

Notwithstanding the above, the right of withdrawal is excluded in cases where, due to the nature of the content of the services, it is impossible to carry it out, without prejudice to claims for damages suffered, or when the goods returned to the warehouse or their packaging are not complete or in perfect condition.

You have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, acquired physical possession of the goods (or, if applicable, the last of those goods).

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax, or email) indicating your name, full address, and, if available, your telephone number, fax number, and email address to atcliente@jgc.es.
